Diese Bedingungen gelten für die Nutzung der App „Orb" sowie dieser Website. Für den Kauf bzw. Bezug der App über den Apple App Store gelten zusätzlich die Standard-Lizenzbedingungen für Endnutzer von Apple (EULA), sofern kein individueller Lizenzvertrag hinterlegt ist.
These terms apply to your use of the "Orb" app and this website. Purchasing or obtaining the app through the Apple App Store is additionally governed by Apple's Standard End User License Agreement (EULA), unless a separate custom license is provided.

Orb ist eine persönliche Journaling-App mit einer optionalen, vollständig auf dem Gerät laufenden KI-Schreibbegleitung. Orb ist kein Medizinprodukt, keine Therapie- oder Diagnose-Software und ersetzt keine professionelle medizinische, psychotherapeutische oder psychiatrische Beratung oder Behandlung.
Orb is a personal journaling app with an optional, fully on-device AI writing companion. Orb is not a medical device, not therapy or diagnostic software, and does not replace professional medical, psychotherapeutic, or psychiatric advice or treatment.

Orb richtet sich an Nutzer:innen ab 16 Jahren. Bist du jünger, benötigst du die Zustimmung eines Erziehungsberechtigten.
Orb is intended for users aged 16 and up. If you're younger, you need the consent of a parent or legal guardian.
4. Deine Inhalte

Alle Journal-Einträge, Texte und Fotos, die du in Orb erstellst, gehören vollständig dir. Wir erheben, speichern oder verarbeiten diese Inhalte zu keinem Zeitpunkt auf unseren Systemen — sie verbleiben ausschließlich lokal auf deinem Gerät (siehe Datenschutzerklärung). Für Datenverlust durch Gerätewechsel, -defekt oder -verlust ohne eigenes Backup übernehmen wir keine Verantwortung; wir empfehlen, reguläre iOS-Backups (z. B. iCloud) zu nutzen.
All journal entries, text, and photos you create in Orb belong entirely to you. We never collect, store, or process this content on any system of ours — it stays exclusively on your device (see the privacy policy). We take no responsibility for data loss from a lost, damaged, or replaced device without your own backup; we recommend using regular iOS backups (e.g. iCloud).

Die App selbst, ihr Design, Name und Markenzeichen sind Eigentum von Robin Mesaric. Du erhältst ein einfaches, nicht übertragbares Nutzungsrecht im Rahmen der Apple-EULA.
The app itself, its design, name, and branding are the property of Robin Mesaric. You receive a simple, non-transferable right of use under Apple's EULA.
6. Gewährleistung und Haftung

Orb wird ohne Mängelgewähr („as is") bereitgestellt. Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie nach Maßgabe des Produkthaftungsgesetzes. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) und beschränkt auf den vorhersehbaren, vertragstypischen Schaden. Im Übrigen ist die Haftung ausgeschlossen, soweit gesetzlich zulässig.
Orb is provided "as is," without warranty of any kind. We are liable without limitation for intent and gross negligence, and under applicable product liability law. For ordinary negligence, we are liable only for breach of material contractual obligations, and limited to foreseeable, contract-typical damage. Liability is otherwise excluded to the extent permitted by law.

8. Anwendbares Recht & Gerichtsstand

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Zwingende verbraucherschützende Bestimmungen deines gewöhnlichen Aufenthaltsorts bleiben unberührt. Gerichtsstand ist, soweit gesetzlich zulässig, Berlin.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your place of habitual residence remain unaffected. Where legally permitted, the place of jurisdiction is Berlin, Germany.
